Purchase of a Life Lease

What is actually purchased within this village?

At Rossmoyne Waters all apartments and villas remain the property of the Operator. The Resident purchases a Life Lease (or Lease for Life) under an agreement (or Contract).

In consideration of the Resident paying to the Operator the required Ingoing Contribution the Owner and the Operator give the Resident the right to live in the unit on and from the date set out in the Residence License Agreement for the Resident’s lifetime. The Resident can occupy the specified Premises under licence and the type of occupancy is “self-care”.

Only residents whose names appear on the contract, are entitled to live in the premises under the Life Lease agreement (or Contract).

Payment of premium and refund entitlement

The Ingoing Contribution payable for an apartment or villa within Rossmoyne Waters depends on the size, location, features and quality of the villa or apartment. The Ingoing Contribution is the total cost to enter the village. Administration fees, State taxes and similar are not applicable to a life lease. Indicative prices are as follows:

  • 2 Bedroom Villa – $464,000-$764,000
  • 2 Bedroom Apartment – $718,000-$1,279,000
  • 3 Bedroom Villa – $751,000-$764,000
  • 3 Bedroom Apartment – $757,000-$1,501,000

The refund entitlement payable at contract termination is based upon a percentage of the original Ingoing Contribution (IC), with or without any capital gains as determined by the Deferred Management Fee (DMF) option chosen by the resident at the time the contract is established.

Adventist Care offers two DMF options and the detail of these are available from Adventist Care. In summary the following options include;

Option 1 – “Classic”, which has a maximum DMF of 25% after 3 years with No Capital Gains.

Option 2 – “Advantage”, which has a 40% Maximum DMF over 10 years with Capital Gains

Charges for village operating costs

General Service Fees (GSF) are used for, but are not limited to, repairs and maintenance, meeting fire and safety requirements, insurances, rates and taxes, cleaning of common areas, water consumption, street lighting, pest control, security and rubbish removal.

The General Service Fee is equivalent to 25% of the Australian Basic Single Age Pension. Currently the GSF is set at $596.00 per month. (March 2026)

Budget surplus

Any budget surpluses are applied towards future village expenses.

Residents can be involved in the process of applying budget surpluses. This can be done by way of a special resolution at an officially called meeting of the residents.

General Service Fees increased by 1.9% in the 2025/2026 financial year.

No, a resident cannot be liable for any additional charges however, should a resident cause extraordinary damage to the operator’s property due to abuse, neglect or in breach of the village rules, the cost to repair may be charged to the resident’s account.

Reserve funds

Repairs and maintenance of Operator owned property items are funded through normal operating budgets. Replacements and renovations are funded from an unincorporated company which holds all land and building assets.

Currently residents do not contribute to any reserve funds at Rossmoyne Waters

Resident funded capital improvements

All capital improvements must be pre-approved by Management and professionally installed at the resident’s expense. No compensation is given to residents who have made approved capital improvements to their unit.

Amenities and services

All extra amenities and services in addition to those provided under the recurrent charge, such as the use of the pool, spa, gym etc., are provided to the residents free of charge. Once off fees apply to events run by the Operator such as shopping bus trips, excursions and special events.

In addition to those listed above the Village is usually also serviced by medical doctors, podiatrist, meals service from the aged care kitchen and hairdresser. Costs to residents vary and information is available if requested.

Existing service contract

By definition, a Service Contract is a business agreement between a contractor and/or a customer covering the maintenance and/or servicing of equipment/service over a specified period. Service contracts are usually established to attract group/bulk pricing and other benefits.

Within Rossmoyne Waters the following existing service contracts currently exist and residents are bound to these arrangements:

Villas – There are no current service contracts in existence that would bind a resident to a particular service provider. Residents are free to engage their own power, gas and phone/internet service providers.

Apartments – Residents are free to engage their own phone/internet service providers. The electricity power, entering the apartments is provided throughout by a system known as an embedded network.

Residents in Australis will be required to contact WinConnect (1300 167 671) or email (enquiries@WINconnect.com.au), to set up their account to supply power to the apartment. Note, there is no gas in the apartments.

Residents in Horizon will be required to contact BrightConnect (1300 908 760) or email (connect@brightconnect.com.au) to set up their account to supply power to the apartment. Note, there is no gas in the apartments.

Insurance

The Operator covers all insurance costs except the personal contents of a resident’s unit. Insurance cover is provided for the buildings and fixtures i.e. carpets, blinds etc.

Insurance cover is based on replacement costs and as mentioned above, does not include the resident-owned contents. Residents are encouraged to make provisions ensuring they have insurance cover for their personal property within the Village.

The Operator takes no responsibility for any personal property within Rossmoyne Waters

Village management

The Adventist Care Board of Directors and the CEO of Adventist Care ensures that management staff have suitable qualifications and experience to fulfil their roles.

No, the management of the village cannot be assigned to a third party.

No, there currently is no mandatory accreditation for the industry however Adventist Care complies with all of the requirements under the relevant State Legislation for retirement villages.

In accordance with relevant legislation, annually at the residents’ Annual Meeting (AM) which is held in November, when Residents elect a Residents Representative Committee.

Resident consultation

Residents appoint a Resident Committee which recommends to the Village Management.

Village guidelines are established but can be altered by the Operator when necessary. Resident charges are adjusted according to Consumer Price Index figures for Perth. Residents are given advance notice of any change in rates.

Adventist Care operates under standard residence contracts, known as residence licence Agreements (RLA). The rights and obligations as stated in those contracts cannot be altered. Residence contracts and associated rights and obligations can be terminated by the resident giving advanced, written notice of at least one month stating their intentions to vacate the premises. The operator cannot terminate the contract without the agreement of the resident. In all cases compliance with relevant legislation will apply.

Resident voting rights

Yes, each resident listed on a residence agreement is entitled to vote on such matters.

Proxy votes are available for the resident’s convenience and are valid only for the meeting in which they are given. Proxy votes must be in writing and be signed and be given to the Chair of the meeting before the meeting commences.

Use of residential premises

Lifestyle choices?

Rossmoyne Waters, recognising the benefits of a holistic, positive and balanced lifestyle, chooses to remain a place where illicit drug and tobacco consumption (smoking/vaping of any kind) is not permitted. Alcohol is not to be consumed in any common amenity or public area within Rossmoyne Waters.

Again, within the holistic approach to healthy lifestyles, Rossmoyne Waters promotes the benefits of plant-based foods. Vegetarianism is promoted by Adventist Care for its welldocumented health benefits, however vegetarianism is not mandated. Where non-vegetarian foods are selected to be prepared and served in Rossmoyne Waters common amenities, residents are requested to avoid conflict with the Rossmoyne Waters’ health principles by respecting the ‘clean’ (acceptable) and ‘unclean’ (unacceptable) flesh foods. Having someone else live with him/her?

Only those residents listed on the Life Lease Contract are permitted to live in the Village. Guests may stay with residents but village guidelines must be adhered to regarding short term guests.

Having visitors, including short-stay guests?

There is a two week limit for guests staying with a resident. Written consent from the Operator is required for longer periods.

Car parking?

Most villas have an attached garage or carport. Apartments are assigned underground parking bays. There are visitor car bays throughout the Village.

Pet policy

The keeping of animals such as dogs and cats is not permitted. Other pets, such a small- caged birds and aquarium fish that do not negatively impact other residents are permitted.

Pets may be brought occasionally into the retirement village on a day only visit basis, however the visiting pet is not permitted entry into buildings, must be restrained at the minimum on a leash at all times and must be accompanied by a responsible adult at all times. Any mess or damage caused by a visiting pet must be rectified by the person responsible for the pet while on the property.

Spouse or de facto partner occupancy rights

The Life Lease contract terminates on the death of the last surviving Resident under the contract. The right of occupancy cannot be transferred to any other person.

Transport

Currently, Management operates a shopping bus to shops in the local area approximately once every fortnight. For a timetable, please contact the Resident Services Office. Transperth also operates a public bus service which can be accessed via designated bus stops on Bull Creek Road. Timetables for this service can be sought directly from Transperth. The metropolitan railway service is accessible via the Transperth buses.

Medical certificate requirements

No, this is not a requirement to live in the village. It is recommended that Village Management be informed if a resident has any life-threatening illness. Whenever a resident is admitted to hospital, Village Management should be informed.

No, this is not a requirement to live in the village. ARC does encourage all residents to display in a designated location within their unit, basic medical information and contact details to be used in the event of an emergency.

Emergency call procedures

Adventist Care does provide an emergency call system for maintenance needs and the contact number can be accessed 24 hours per day. However, should a resident require a medical emergency call system such will need to be sought from one of the reputable service providers of these devices. There are many monitored and not-monitored services available.

In the event of a maintenance emergency, the first point of call is the Maintenance Supervisor. For a medical emergency the first point of call is the ambulance or similar.

If hospitalization is required, the closest hospitals are Fiona Stanley (Murdoch) and St. John of God (Murdoch).

Hospitalisation

The premises will be kept in the name of the resident until the death of the resident or upon receiving one month’s written notice from the resident of the intention to vacate the premises.

All General Service Fees are applicable and must be paid by the resident while the residence contract is in place. There is no reduction in costs due to hospitalisation or nursing care. When the premises are vacated and the keys surrendered to Management the account for the premises is closed.

Moving

Costs associated with moving within the village are the responsibility of the resident unless the move was initiated by Adventist Care, in which case a negotiated arrangement may be necessary.

The only time that a resident would be requested to relocate within the village would be if the resident’s unit was located in a proposed village redevelopment zone. The relocation would not take place unless there was mutual agreement between Adventist Care and the resident regarding the relocation terms. Village redevelopments are infrequent, but necessary to meet the needs of existing and future residents.

Should a resident’s level of health give cause for serious concern for their safety, Adventist Care may feel obligated to strongly encourage the resident to either relocate to aged cared or vacate the village.

Village under construction

Typically, when there is a village redevelopment, designs, construction and furnishings are standard across the village as much as possible. In some circumstances, prospective residents may have some input if Adventist Care determines this to be appropriate. Generally residents are offered villas and apartments “as seen” or according to the stated specifications.

Prospective residents may be required to pay extra for modification and or upgrades to their premises under construction should such changes be agreed and recorded in writing.

Refund of deposit

Should the prospective resident decide to withdraw from the sale of a Life Lease, in writing, Adventist Care will return the full deposit paid to secure the unit and the unit will then become available to any other prospective resident. Such a refund only applies before the prospective resident moves into the premises.

Sale of village

Legislation requires a Memorial to be placed upon the property Title and this designates the specific usage of the land (a retirement village). The Contract between the Resident and the Operator / Owner formalises the rights of the Resident to the property specified as covered by the Memorial.

Restrictions on sale of residential premises

Premises are not sold to prospective residents. Prospective residents purchase a licence to occupy the premises for their lifetime (‘Life Lease’ or ‘Lease for Life’). Therefore, sale restrictions of disputes will not occur. The sales of all licences are processed by Adventist Care and facilitated by the Retirement Living Consultant.

Repair and refurbishment of residential premises

Generally, all regular maintenance is conducted by Adventist Care and covered by the monthly General Services Fee paid by the resident. However, wilful acts of destruction and carelessness may attract Adventist Care’s request for the resident to repair or replace the damaged items.

When the resident permanently vacates the premises, the resident must leave the premises (including all fixtures, fittings, furnishings and other items provided with the premises) as nearly as possible in the same condition (fair wear and tear excepted) as when the resident first occupied the premises. The resident is not liable to refurbish, nor pay for the costs of the refurbishment of, the premises when the resident permanently vacates the premises. Where unauthorised alterations are found within the premises the vacating resident may be required to reinstate the affected areas to their original condition.

Should resolution in such a dispute be not attainable through the Village Management, the matter should be addressed by the Adventist Care Board of Directors. Further, should resolution not be attainable, a resident can apply to the State Administrative Tribunal.

Termination of contract

The Residential Licence Agreement can be terminated at any time by the resident by giving one month’s notice to Adventist Care. The termination will not attract any termination fee. The Termination of the Contract does not affect any other right or obligation of a party under this Contract. The Operator cannot terminate this Contract without the agreement of the Resident or an order of the State Administrative Tribunal.

When a unit is vacant the only cost to a prospective or terminating resident is the General Service Fee. The General Services Fee is applied from the time a new resident takes possession of the keys to a unit and until those keys are returned and the unit is permanently vacated.

Home Care Services

Yes, Adventist Care is a registered provider of Home Care Services and would be delighted to assist residents who require assistance in the tasks of daily living. The services available from Adventist Care’s Home Care Service vary and for details an enquiry to the Resident Service Office is recommended.

Yes, Adventist Care is able to provide its Home Care Services to all residents who have or not have a government funded Home Care package. Adventist Care will charge the resident directly when government funding is not available.

Residents benefit from services provided by familiar, trained and trusted providers. At Adventist Care the continuum of care provided ensures the resident received the best care throughout their Rossmoyne Waters experience.

While other home care service providers may enter the village to provide their support, they cannot provide the continuum of care that is exclusively available from Adventist Care.

Volunteering with Rossmoyne Waters

Adventist Care encourages residents to remain active in community engagement. There are many opportunities for residents to be engaged in volunteer activities with Adventist Care. For more details on volunteering in Rossmoyne Waters please make an enquiry at the Resident Services Office.

If, since the publication of this document, retirement village legislation changes, then the requirements of that legislation will apply.
